Proteccionismo inverso y política comercial dentro del sistema multilateral de comercio: el caso de las restricciones a la exportación:

Resumo

Desde a criação da OMC, alguns processos foram recebidos de seus estados-membros com relação à adoção de restrições à exportação. Essa política comercial pressupõe um novo tipo de protecionismo, denominado “protecionismo reverso”, que não parece estar totalmente regulamentado pelas disposições do GATT. Embora certos artigos pareçam lançar alguma luz sobre o assunto, já que são invocados em algumas diferenças do total acumulado até o momento, como o “Artigo VIII Taxas e Formalidades Relacionadas à Importação e Exportação” e o “Artigo XI Eliminação Geral de Restrições Quantitativas”, entre outros, em suma, a OMC não consegue remediar essa situação. Portanto, é fundamental que o sistema de comércio multilateral conduza um novo processo de negociação no qual seja desenvolvido um acordo definitivo para regular esse tipo de política comercial.

Jose Jaime Baena Rojas, Institución Universitaria CEIPA

PhD in Law and Political Science from Universidad de Barcelona (Spain); holds a MSc. in Internationalization from the same university and a Sp. in International Trade from Escuela Europea de Dirección y Empresa (EUDE), graduated in political science from Universidad Nacional de Colombia and graduated in International Business from Institución Universitaria Esumer (Colombia). He is full time professor on distance at Institución Universitaria CEIPA (Colombia), and a researcher at Business and International Relations Research Group of the same university.
