Resumo
It will be addressed in this article the relationship between the right to life and the criticism of the same life in terminally ill patients, as well as the circumstances of incidence of the Will Advance Directives in Health Care, in accordance to the Constitution of Brazil, to the infra-constitutional rules and to the ethical status applied to the corresponding cases, named the Brazilian Code of Medical Ethics, issued by the Federal Council of Medicine and, finally, the prospects for the creation of a legal provision regulating the use nationwide of the Advance Directives, underway in the Brazilian Parliament, alongside the existing law limited to the territory of the Federal State of São Paulo.
